These changes may be made, through its websites, by any means admissible by law and will be binding during the time they are published on the website and until they are validly modified by subsequent changes. However, engrís reserves the right to apply, in certain cases, Specific Contract Conditions with preference to these General Conditions when it deems appropriate, announcing them in a timely and appropriate manner.

As a user or client, you expressly declare that you know, understand and accept the conditions of use and these general contracting conditions.

In accordance with the provisions of Organic Law 15/1999 on the Protection of Personal Data, engrís informs users that the personal data collected during the registration process and subsequent purchase will be entered into a file under its responsibility, for the purpose of processing such actions by the user and managing subsequent actions derived from them. Likewise, engrís informs users of the possibility of exercising their rights of access, rectification, cancellation, and opposition by writing to the email address engris@engris.es.

Unless you tell us otherwise, we will assume that your data has not been modified, that you agree to notify us of any changes and that we have your consent to use them in order to strengthen the relationship between the parties.

You are responsible for treating the identity and password obtained during customer registration confidentially and responsibly, and may not transfer them to another person. You can modify the information registered at any time by going to the “My account” section of the website.

Once the purchase process has been completed, the customer will receive confirmation of the purchase by email. It is essential that a valid email address is identified during user registration. If you do not receive confirmation within 24 hours of completing the order, please contact engrís at engris@engris.es.

In this same section of “My account” you will have access to a history of your orders and your discount vouchers. This is only a consultation section but its management is allowed, and the user can delete those records that he considers it is not necessary to view.

All content on the website is in Spanish.

The customer, upon purchasing the order, will receive an invoice for it in their email.

The products offered in our online store have their essential characteristics detailed.

In the case of a product on sale, the offer price and validity of the offer will always be indicated along with its essential characteristics.

In compliance with current regulations, engrís offers information on all its products, their characteristics and prices. However, engrís reserves the right to withdraw, replace or change the products offered through its website, by simply changing the content of the same. In this way, the products offered at any time on the website will be governed by the General Terms and Conditions in force in each case. Likewise, the company will have the right to stop offering, without prior notice and at any time, access to the aforementioned products.

PRICES

All products indicate the sales price in Euros and include Value Added Tax (VAT).

If any other tax is applicable, this will be indicated.

Expenses and provision of products

Engrís only makes products in the Peninsula, Balearic Islands, Andorra, France, Italy and Portugal, charging a variable amount for shipping costs that will be detailed before confirming the order.

Payment methods and product execution

The customer may pay for their products by choosing any of the following methods. During the purchasing process they must indicate their choice:

Ø VISA or MASTERCARD credit card

All operations involving the transmission of personal or banking data are carried out using a secure environment, a server based on the standard SSL (Secure Sockets Layer) security technology. All information you transmit to us travels encrypted over the network.

Likewise, your credit card details are entered directly on the bank's website, in the POS (Bank Point of Sale Terminal) and are not entered or recorded on any ENGRÍS server.

When paying with a VISA or MASTERCARD card, you will always be asked for the following information: the card number, the expiration date, and a Validation Code that matches the last 3 digits of the number printed in italics on the back of your VISA or MASTERCARD card, thus offering more guarantees about the security of the transaction.

This payment method is only valid on the web.

When the amount of a purchase has been fraudulently or improperly charged using a payment card number, the cardholder may demand immediate cancellation of the charge. In such case, the corresponding debit and credit entries in the accounts of the supplier and the cardholder will be made as soon as possible.

However, if the purchase had actually been made by the cardholder and the request for a refund was not a consequence of having exercised the right of withdrawal or termination and, therefore, had unduly demanded the cancellation of the corresponding charge, the cardholder will be obliged to compensate ENGRÍS for the damages and losses caused as a consequence of said cancellation.

SHIPPING

The minimum delivery time to collect or receive your order is 24-48 hours, and to this must be added the delivery times that the transport operators we work with may have. Delivery times are calculated based on working days from Monday to Saturday. engrís does not make deliveries on holidays or Sundays.

The delivery times indicated are indicative. In the event of a stock shortage or temporary unavailability of an item, engrís will contact you to inform you of the new delivery time. If delivery is not possible, cancellation will be communicated. In any case, a delay in delivery with respect to the indicated times does not entitle the customer to demand any compensation.

Delivery methods

We have different delivery methods for your order, so you can choose the one that best suits your needs. The delivery methods are:

1) DELIVERY BY LOGISTICS OPERATOR

To transport and deliver your order, engrís es uses an external logistics operator that offers fast and efficient transport. Items are delivered to your home. The cost of transport will be calculated automatically based on each order placed and will appear detailed separately.

2) COLLECTION

The customer may choose to pick up the order at the physical space that engrís has in Barcelona, ​​on Rubinstein Street, 2

RIGHT OF WITHDRAWAL, REFUND OF PAYMENT AND CLAIMS

The customer will have a minimum period of fourteen calendar days to withdraw, from the date of the contract, without penalty and without stating the reasons.

The right of withdrawal must be exercised by email notification to engris@engris.es , specifying full name, address, date of purchase, proof of purchase and item(s) you wish to return.

According to the provisions of article 103 of Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of Consumers and Users, supplies of products or goods made according to the consumer's specifications or clearly personalized, or which, by their nature, cannot be returned or may deteriorate or expire quickly, are exempt from withdrawal.

– The return

The customer must return or deliver the product directly to engrís, at the address Pallars, 1 08349 Cabrera de Mar (BARCELONA), without any undue delay, and in any case within a maximum period of fourteen calendar days from the date on which the right to withdraw from the contract is formalised. The deadline will be deemed to have been met if the customer returns the product before the end of the deadline.

The customer will be responsible for the costs of returning the product.

In any case, the products to be returned must be in perfect condition, unused and in their original packaging. Therefore, to avoid problems during transport, please ensure that the package is properly protected and sealed. Once received, we will check their condition. Once we verify that both the item(s), as well as any components, accessories, promotional gifts and documentation, are complete and in perfect condition, we will proceed to refund the money paid.

– Refund of payment

Refund of amounts received by the customer will be made using the same payment methods used by the customer, unless otherwise agreed.

engrís may retain the refund until it has received the product, reason for withdrawal, or until the customer provides proof of return of the same, depending on which condition is met first.

In the event of unjustified delay on the part of engrís, with respect to the return of the sums paid, the client may claim double the sums paid, without prejudice to the right to be compensated for damages suffered in excess of this amount.

– Return of the defective product.

If upon delivery of an order you detect that the packaging has been manipulated or damaged, you must note the reason on the carrier's delivery note and sign it.

In the event that the product is not in good condition and the causes attributable to it are not the client's fault, the client will have the right to return the product, informing engrís of the reason for the return through any of the means provided in these contracting conditions, and at no cost to the client. This return due to defect or poor condition of the product will not be considered a right of withdrawal.

The company undertakes to assume the cost of the return and to replace the product with a new one in accordance with the conditions accepted at the time of sale.

JURISDICTION

Likewise, engrís reserves the right to file any civil or criminal actions it deems appropriate for the improper use of its website and content or for failure to comply with these conditions.

The relationship between the user and the provider will be governed by the regulations in force and applicable in Spanish territory. If any dispute arises, the parties may submit their conflicts to arbitration or resort to ordinary jurisdiction, complying with the rules on jurisdiction and competence in this regard.
